Babri demolition: Will abide with CBI court's ruling, says Vinay Katiyar

Uttar Pradesh Chief Minister Yogi Adityanath greeted LK Advani with flowers as the BJP patriarch arrived at a posh Lucknow guest house, before appearing in a city court where charges will be framed against him in the Babri Masjid demolition case.

LK Advani, Murli Manohar Joshi, Uma Bharti, Sadhvi Rithambara, Vishnu Hari Dalmai, Vinay Katiyar, Ram Vilas Vedanti, Mahant Nritya Gopal Das, Mahant Dharamdas, Champat Rai Bansal, Baikunth Lal Sharma and Shiv Sena leader Satish Pradhan will be present in the court on Tuesday, the Hindustan Times reported. If the court rejects the application, then charges against them will be framed, said their lawyer Prashant Atal.

The special court had dropped charges against the accused Advani, Joshi, Uma Bharti including Bal Thackeray and others in May, 2001. The apex court also said there will be no "de novo" (fresh) trial. It also transferred the trial of a separate hate speech case from Rae Bareli to the special court in Lucknow for a joint trial with the main demolition case.

The CBI court will frame charges today against BJP leaders Advani, Murli Manohar Joshi and Uma Bharti in the Babri Masjid demolition case.

The CBI, however, moved the Supreme Court which in its April 19, 2017 order, asked the CBI Court to add conspiracy charges against the accused in the trial.

The apex court also directed the trial court in Lucknow to commence the proceedings in four weeks and hear the matter on a day-to-day basis so as to complete the hearing in two years.

A special CBI court had last week mentioned that the leaders would not be allowed to ask for an exemption from appearing in person.

However, the top court had said BJP leader Kalyan Singh, who is the Rajasthan Governor and during whose tenure as the chief minister of Uttar Pradesh the disputed structure was razed, was entitled to immunity under the Constitution as long as he held the gubernatorial office.
