Trump not under investigation for firing ex-FBI chief Comey - lawyer

The Democratic National Committee called on Rosenstein to recuse himself from the Russian Federation matter, but it said authority over the investigation should be given to Mueller and not another Trump appointee.

Comey told the Senate hearing that he believed he was dismissed by Trump because he did not stop the FBI's investigation into Flynn.

"The tweet from the president was in response to the five anonymous sources purportedly leaking info to the Washington Post", he said, referring to a recent story about special counsel Robert Mueller allegedly looking into whether Trump fired Comey last month in an attempt to obstruct an investigation into alleged Russian meddling in the United States election.

Rosenstein has said privately he may need to recuse himself from matters relating to the Russian Federation probe because he could become a witness in the investigation, ABC News reported on Friday.

Comey told a Senate panel last week he believed Trump fired him to undermine the FBI's Russian Federation probe. Sources tell ABC News that he may have to pull out since he does have final say over parts of the special counsel's investigation.

"He is a man of extraordinary independence and integrity. and great character", Vice President Mike Pence told reporters on Wednesday, noting that the longtime Justice Department official "came to work, sat down and made his recommendation" to fire Comey.

Dianne Feinstein, top Democrat on the Senate Judiciary Committee, said she was "increasingly concerned" that Trump will fire both Mueller and Rosenstein.

Rosenstein is at the center of Comey's departure: His memo to Attorney General Jeff Sessions is the basis that White House officials and Trump himself have used to defend Comey's dismissal, despite the FBI's ongoing investigation into the 2016 campaign and Russia's attempts to help Trump win.

Rosenstein took command of the investigation in early March, when Sessions announced that he was recusing himself due to his substantial role in Trump's presidential campaign past year. And, short of firing Mueller - which would be political suicide for Trump - he just has to wait and see how it plays out. What is clear is that he could order the Justice Department to ax Mueller, which may result in Rosenstein's departure and would certainly intensify the uproar over the investigation.

However, White House press secretary Sean Spicer denied Ruddy has spoken to the President about the issue.

It also asks former transition officials to retain records related to five former Trump campaign associates: former campaign chairman Paul Manafort; his deputy Rick Gates; former foreign policy adviser Carter Page; retired Lt. Gen. Michael Flynn; and Roger Stone, a longtime Trump adviser.

"He brought that recommendation to the President" and Trump agreed, Pence concluded. A former prosecutor, Dowd may be best known to the public for leading investigations on behalf of Major League Baseball, including a probe of allegations of improper gambling by baseball player Pete Rose that preceded Rose's lifetime ban.
