Bill Cosby jury quits for the night, no verdict

NORRISTOWN, Pa. (AP) — For all the ways the judge in Bill Cosby's sexual assault trial has streamlined the case inside the courtroom, the frenzy outside grows larger and wilder each day of jury deliberations.

Jurors have deliberated for more than 21 hours since getting the case Monday. "The judge was very adamant that the jury's job, and it's not ours because we don't hear all of the evidence, but they are the ones who are going to hear every piece, every shred of evidence and it's for them to make a decision not based on bias or anything else, except for the facts of the case".

The jury began their deliberation on Monday, June 12, then returned to work Tuesday, June 13, to review important evidence like the testimony of the police officer who first interviewed one of the complainants, Andrea Constand, back in 2005.

Wyatt released the statement just moments after jurors asked the judge to define the phrase "without her knowledge" as it applies to one count of aggravated indecent assault while delivering an intoxicant. "I am not stopped" (Constand denies sexual activity; she testified she rebuffed Cosby when he touched her trousers by leaning forward).

The verdict was to be called on Tuesday, but the fate of famed USA comedian, Bill Cosby, will have to wait till at least Wednesday, June 14, in the criminal case against him involving alleged sexual assault of a woman in 2004.

The three charges accuse Cosby of assaulting Constand without her consent, assaulting her when she was unconscious and assaulting her using drugs to substantially impair her ability to consent. Each carries a maximum 10-year term, though the counts could be merged at sentencing if he is convicted.

Dozens of women have come forward to say Cosby had drugged and assaulted them, but this was the only case to result in criminal charges.

Constand testified over two days last week for the prosecution.

"She's on the phone with lawyers before she told her mom anything", he said, his voice rising regularly in agitation. But you don't have to support them. Constand told police she was semiconscious as he molested her. " 'I have three friends for you to make you relax'".

She became incapacitated and felt "frozen" and told him so, she testified. A mass murderer is still a person, a child pornographer is still a person, and yes, in Cosby's case specifically, a serial sexual abuser is still a person.

She woke up on the couch early in the morning with her clothes disheveled, she said.

"Think about that, in terms of the courage Andrea Constand has shown", Montgomery County District Attorney Kevin Steele said in closing arguments as Constand sat with detectives, her mother and other accusers in the front row. "I wanted to do what I would have wanted to receive".

Cosby lowered and shook his head in the courtroom as she spoke.

McMonagle cited gifts and phone calls between Cosby and Constand to show she was more than a college sports staffer trying to placate a powerful Temple University trustee. On Monday, he urged the jury to reject the idea that Constand's sexual encounter with Cosby had been consensual. Cosby says they enjoyed a mutual "petting" session.

He highlighted inconsistencies from Constand, who initially gave different dates for the alleged assault and varied details about events before and after.

The comedian also faces a defamation lawsuit by model Janice Dickinson, who claims Cosby drugged and raped her in Lake Tahoe, California, in 1982. They pointed to Ms Constand's initial statement to police in 2005 that she had never been alone with him beforehand and cut off all contact afterward, both untrue. Hotel rooms are sold out for miles.

There can be no doubt that Cosby, along with the rest of the country, waits with bated breath to see what fate awaits him. That it couldn't have been assault if she had an orgasm.

Constand said she woke up, groggy, sore and disheveled, around 4 a.m.
