Senate lifts suspension on Ndume

Former majority leader of the upper legislative chamber, Senator Ali Ndume, who was controversially suspended about eight months ago, has been recalled by the Senate.

Deputy Senate President, Ike Ekweremadu disclosed this after the closed meeting that lasted less than twenty minutes.

According to Ekweremadu: "We discussed the suspension of Ndume and we resolved that he should resume tomorrow since he has served 90 days without prejudice to the current court process".

Ndume was in March suspended for six months for "deliberately" bringing up an issue the upper legislative chamber describes as portraying it in a bad light.

The appeal of the senate contested the judgment of the lower court in its entirety on six grounds of appeal and asking the court to allow the appeal, set aside the judgment of the lower court and dismiss the suit for want of jurisdiction.

The Senate had on Monday filed an appeal against the judgment of the Federal High Court, delivered today, 10th of November, 2017 which declared the suspension of Ndume null, void and of no effect.

The judge, in addition, directed the Senate and its President, to pay to the Ndume his outstanding salaries and allowances with immediate effect.

Both men had appeared before the Senate Committee on Ethics and privileges and were cleared of the allegations.

Mr. Ndume challenged his suspension in Court.

"The court has so declared that it was not right and it was illegal". "The Senate of the Federal Republic of Nigeria which has the strong conviction that the decision of the trial court will be overturned by the Court of Appeal, has accordingly instructed the law firm of Mike Ozekhome's Chambers, to file an appeal against the judgment immediately", Ozokhome stated.

"That the Plaintiff wrongly joined several causes of action in his Originating Summons".

"That by the provisions of sections 3 and 30 of the Legislative Houses (Powers and Privileges) Act, " he said the trial court lacked requisite jurisdiction to hear the suit of the Plaintiff.
