A herpes lawsuit against Usher Raymond has been dismissed, but that's not necessarily good news for the R&B singer. Helm's new attorney immediately filed to have the case against Usher dismissed. But there's a catch - the case was reportedly dismissed with "intent to refile".

According to another lawsuit filed by a celebrity stylist against Usher, the singer was diagnosed with herpes in 2009 or 2010, People reported.

Helm, who originally filed a lawsuit against Usher under the alias Jane Doe, claimed that she had unprotected sex with the singer and was subsequently transmitted herpes.

It's unclear why Helm's lawyer made the move to dismiss. She had a problem she told someone on a recorded phone call 2 days before the suit was filed that she only had protected sex with Usher, TMZ reports.

Usher's lawyer, Steve Sadow, told People in a statement, "It's our honest hope that this dismissal will bring an end to the opportunistic litigation against Usher in Georgia". The three alleged victims took legal action after it emerged the "U Make Me Wanna" singer had paid a woman $1.1 million in 2012 to settle a lawsuit after she claimed to have contracted herpes from the star.

California law states that it is illegal to knowingly or recklessly transmit an STD.

Sharpton claimed that while she didn't contract herpes from Usher, he exposed her to it.
