The governor plays a similar role in the states. The Congress tally of 21 was short of its 23 in 2013, while the JD (S) took away four seats despite averaging 18,165 votes per seat. The BJP needs eight MLAs and two Congress MLAs, Anand Singh and Pratapgouda Patil, have already "gone missing".

Earlier in the day, the JD (S) in its meeting chose Kumaraswamy unanimously as the leader of the legislative party leader.

"The BJP has only 104 MLAs, the Governor invited Yeddyurappa to form the government in an unconstitutional manner", senior counsel Abhishek Manu Singhvi, who appeared for the Congress, told the three-member bench of Justices AK Sikri, SA Bobde and Ashok Bhushan. HD Kumaraswamy said, "JD (S) MLAs are being offered Rs 100 Cr each". Janata Dal (Secular) has however agreed to form a coalition with Congress, which previously controlled the assembly but saw its share cut to 78 seats from 122 previously.

Alok was alluding to a Gandhi statement in Delhi where the Congress leader recounted an incident involving a near-death experience when the plane he was flying from Delhi to Karnataka suddenly dipped almost 8,000 feet giving the scare of his life.

But after the invitation, the head of the invited party must show he or she has the support of a majority of the legislature's lower house.

Karnataka's voters should be profusely thanked for having provided the nation with a much-needed opportunity to re-discover the notions of constitutional propriety, public morality and political fairness. The petitioner has to satisfy the Court only prima facie that the Proclamation is vitiated by any one or some of the above grounds and burden then shifts on the Council of Ministers to satisfy the Court of the legality and validity of the Presidential Proclamation issued under Article 356.

No party achieved a clear majority in the assembly election results announced on Tuesday, leading to uncertainty over the formation of the next government. Indian television channels reported that Congress was planning to approach the Supreme Court late in the night to challenge the governor's decision. The region threw up some surprises, with Chief Minister Siddaramaiah losing from Chamundeshwari constituency and BJP candidate Preetham Gowda winning from Hassan, the home constituency of former Prime Minister H D Deve Gowda.

BJP leaders have also taken Governor appointment stating that they will form the government as they have secured highest seats. The BJP won just 15 seats in the region, which has a significant Telugu-speaking population. "The BJP's irrational insistence that it will form a Govt.in Karnataka, even though it clearly doesn't have the numbers, is to make a mockery of our Constitution", Gandhi Tweeted.

In the run-up to the elections, while the JD (S) had accused the Congress of being "more risky than the BJP", the Congress had said HD Deve Gowda's party was working as "BJP's B team". "The Congress [coalition] has a clear majority". For Modi, Karnataka is important for two reasons.

"I may also direct you that you would seek a vote of confidence on the floor of the House showing that you command the confidence of the House". "BJP is playing dirty politics and it will not be allowed in Karnataka", he retorted.
