A same-sex couple has accused an Uber driver in New York City of discriminating against them after he allegedly kicked them out of the auto for kissing in the backseat.

The women - a couple in their 20s - were on their way from Brooklyn to Manhattan on Saturday when they exchanged what they called a "peck" on the lips.

They say the driver forced them out.

"The middle seat was open". "That's genuinely all it was". "You don't do that here in the auto ... you are not allowed to do this". "It went from shock to anger", Iovine said.

Iovine said she has yet to receive a response from Uber, adding: 'Getting this out there, getting a refund and getting an apology is all I want right now'. "But that's not what was going on here". As a passenger, if you need to make a phone call, keep your voice down to avoid disturbing your driver or other riders.

The driver said he asked them to stop kissing and lower the volume on their phones. "You don't do that".

In the footage, Mr El Boutari says that kissing in an Uber is illegal - adding: "I don't want to argue with you, just get out of my vehicle".

"Kissing is not illegal", the women protested. "You don't do that here in the auto".

Driver Ahmad El Boutari tells the Daily News one of the women put her feet on the seat. According to a screenshot of his profile, provided to CNN by Pichl, he had a 4.67 rating and received dozens of commendations on the app for "excellent service".

In the video, El Boutari tells the pair: "It is illegal. We always thought we lived in this untouchable New York City bubble where LGBTQ is so accepted", Pichl said.

"We were sitting on opposite sides of the auto", Alex told the New York Daily News.

The women initially thought the man was joking, but once they realized he wasn't they began recording the incident.

"It's my own auto".

Iovine told the MailOnline: "Obviously, he's homophobic".

"He started yelling at us that we were disrespectful and inappropriate and that he wants us out of his vehicle", said Pichl. CNN reached out to the couple about el Boutari's claims. However, the agency told the Daily News that it has not received complaints about the driver in the past and that it has launched its own investigation.

The Taxi and Limousine Commission is investigating.

Iovine said she's aware of Uber's code of conduct, but was adamant that the two did nothing more than a quick smooch.

RAW VIDEO: Uber says it does not tolerate discrimination and is investigating.

Uber's CEO Dara Khosrowshahi told the NY Post that he believes drivers like the one seen in the video "don't belong on Uber". We paid for a full Uber ride.

"It's an unfortunate circumstance and we will do everything we can for that not to repeat". "I would be nervous I think to kiss Emma again in an Uber", Iovine said. "But I think this has inspired us to get our voice out there more and get out there to celebrate everything this community has done, (what) we have to offer as human beings and the rights that we deserve".
