New York files lawsuit against Trump and family

State Attorney General Barbara Underwood on Thursday sued the Donald J. Trump Foundation, Trump, his daughter Ivanka and his sons Donald Jr. and Eric, seeking a court order forcing its dissolution and blocking board members from serving on any not-for-profit organization authorized by NY law.

"This pattern of illegal conduct by the Foundation and its board members includes improper and extensive political activity, repeated and willful self-dealing transactions, and failure to follow basic fiduciary obligations or to implement event elementary corporate formalities required by law".

"Our investigation found that the Trump Foundation raised in excess of $2.8 million in a manner created to influence the 2016 presidential election at the direct and under the control of the senior leadership of the Trump presidential campaign", the attorney general said.

NY is also seeking $2.8 million of restitution plus penalties, a 10-year ban on Trump serving as a director of a NY nonprofit, and one-year bans for his children Donald Jr, Eric and Ivanka.

Trump's children were also named as defendants in the attorney general's petition, filed with the New York State Supreme Court in Manhattan.

Nevertheless, as NY attorney general Ms Underwood has significant investigatory and prosecutorial power - and if she starts flushing the bushes of some of Mr Trump's more questionable charitable activities, there's no telling what she might turn up. "I won't settle this case!"

Prosecutors also want to bar Trump's three eldest children from the boards of nonprofits based in NY or that operate in NY for one year.

The lawsuit also accuses Mr. Trump of using the foundation's charitable assets to pay his legal bills and promote Trump businesses. The suit seeks $2.8 million in restitution and the dissolution of the foundation. Underwood said she has sent letters to the Internal Revenue Service and Federal Election Commission for further investigation.

"For more than a decade, the Donald J. Trump Foundation has operated in persistent violation of state and federal law governing New York State charities", the complaint states.
