The Crown said Osuna's complainant has a 3-year-old with him, now resides in Mexico, wants to continue coparenting, and didn't want to testify, Davidi added.

Wednesday, the Astros (Osuna's current team) and Osuna released statements to inform the public that the assault charges have been withdrawn against Osuna.

After the hearing, Osuna, who nodded when Green asked if he understood the peace bond, issued a statement in both English and Spanish in which he expressed his relief at the conclusion of the case and thanked his family, teammates and fans for their support.

Former Blue Jays pitcher Roberto Osuna's assault case returns to court today in Toronto. Without her testimony there was no way that Osuna would be charged, so the two sides settled on a peace bond.

"I am pleased and relieved by today's court decision", Osuna said.

He said he would have no further comment on the matter, declining to address reporters for a second straight day before Tuesday's game against the Blue Jays, citing advice from his attorney.

Major League Baseball suspended Osuna without pay for 75 games for violating its domestic violence policy and he was later dealt to the Houston Astros.

Osuna was traded to Houston in July and was received by a chorus of boos in Toronto on Monday during his first appearance as an Astro.

Osuna's lawyer, Domenic Basile, told court that his client's agreement to enter the peace bond was not to be construed as an admission of guilt, and that the player had insisted all along he was not guilty. The Astros have said they would not tolerate another incident involving their closer and that the organization is committed to supporting victims of domestic violence.
