Judge Dismisses Ashley Judd's Sexual Harassment Suit Against Weinstein

The actress has accused the disgraced producer of sexual misconduct and maintains he worked to sabotage her career when she spurned his advances.Though the harassment portion of her case against the former movie mogul can not proceed, her allegations of defamation will be heard in court next year.

Gutierrez took pains to say he "is not determining whether Plaintiff was sexually harassed in the colloquial sense of the term", but only whether the incident fell under the scope of the statute her lawsuit cited.

"Nothing about today's ruling changes that Ms. Judd's case is moving forward on multiple claims", he said, adding, "While we respectfully disagree with the Court's decision as to the one claim it ruled on today, we look forward to pursuing the three claims for relief that the Court has already ruled can move forward".

Judd's sexual harassment lawsuit against Harvey Weinstein was dismissed, although her defamation suit against the disgraced Hollywood mogul can move forward.

Since the time Judd's claim was first dismissed, California amended its sexual harassment law. Also, the legislature apparently didn't specifically state that the "new" law can or should be applied retroactively, so he's not allowing Judd to cite it in her suit.

Judd's defamation claim against Weinstein stems from a comment Jackson made in an interview following the flood of accusations against Weinstein in which he said the producer's company, Miramax, discouraged him from hiring both Judd and actress Mira Sorvino as part of what he described as a "smear campaign".

As you'll remember, the case had been winding through the courts after Judd claimed Weinstein shut her out of Lord of the Rings after she turned down one of his alleged sexual demands.

Judge Philip Gutierrez ruled on Wednesday that Ms Judd's legal team had "not adequately alleged that her relationship with Defendant was covered by the statute".

She further claimed that she lost out on multiple film roles because of Weinstein, including one in The Lord of the Rings franchise. He has denied all allegations of non-consensual sex.

Mr Weinstein's lawyer, Phyllis Kupferstein, welcomed the judge's decision.

Weinstein is to stand trial in May in NY on five charges, including rape, involving two other women.

Mr Weinstein has been accused by more than 75 women of varying degrees of sexual misconduct going back decades - allegations he denies.
