'RHONJ' Alum Joe Giudice in ICE Custody Following Prison Release

Joe Giudice has been released from federal prison, but he isn't a free man. His wife, the star of the Bravo reality-TV series, has said that she is considering divorcing her husband if he is deported because their daughters are too young for the family to move to Italy and the couple does not want to have a long-distance relationship. Giudice came to the United States from Italy with his parents when he was 7 years old and while he was a legal USA resident, he never applied for citizenship.

The 46-year-old, whose real name is Giuseppe Giudice and who shares four daughters with the Real Housewives of New Jersey star, was released from the Allenwood Low Federal Correctional Institution in Pennsylvania that morning but remains in federal custody-now by U.S. Immigration and Customs Enforcement (ICE), the group confirmed to E! "I decided this case as a matter of law".

James Leonard, the Giudices' attorney, told ET that the family is "optimistic that once his appeal is heard, he will receive the appropriate relief and will be able to come home and remain there with his family".

"Mr. Giudice has finished serving his federal prison sentence and was transferred early this morning from the Bureau of Prisons to a facility in western Pennsylvania which houses immigration detainees", the statement reads.

Giudice and wife Teresa pleaded guilty in 2014 to financial fraud.
