Apple, Foxconn Broke a Chinese Labor Law

Apple and Foxconn have admitted to violating Chinese labor laws after an investigation by a non-profit advocacy group. Workers earn roughly $1.68 U.S. per hour standard and $2.52 United States per hour for overtime, a wage, "insufficient to sustain the livelihood for a family living in Zhengzhou city", says China Labor Watch.

In Apple's most recent report, the organization said it led in excess of 44,000 meetings in 2018 with representatives of providers to guarantee they got preparing and knew about legitimate channels to voice concerns. "We have confirmed all workers are being compensated appropriately, including any overtime wages and bonuses, all overtime work was voluntary and there was no evidence of forced labor", the company added.

China Labor Watch said temporary staff, known as dispatch workers, made up about 50 per cent of the workforce, which included student interns at Foxconn's Zhengzhou plant in China. Foxconn, who is contracted to build iPhones, has been employing way more temporary workers than it's allowed to according to Chinese law. By recruiting these laborers, "the factory does not need to increase the wages for all regular workers", it said. Dispatch workers are essentially temporary staff that do not receive certain benefits.

Apple acknowledged the percentage of dispatch employees exceeds the limit and it is "working closely with Foxconn to resolve this". The NGO also alleged that many workers never received bonuses promised to them by recruiters.

Under China's labour laws, temporary workers can only comprise up to 10 per cent of any given company's workforce. This is despite Chinese labor laws saying that workers must not work more than 36 overtime hours per month. "There have been intervals exactly where employees have one relaxation day for each 13 days labored or even have only a single rest working day for a month".

Apple's provide chain has confronted criticism over reduced labor requirements for years, and the company has pushed manufacturing partners to enhance factory circumstances or risk shedding enterprise.

"We believe everyone in our supply chain should be treated with dignity and respect".
